These general terms and conditions are intended to regulate the relations between Vintage Summer EOOD, UIC 203592872, with registered office and management address: Sofia 1330, Rumyana Str., bl. 22, ent. A, apt. 12, hereinafter referred to as the “SUPPLIER”, and the customers, hereinafter referred to as the “ USERS ”, of the online store https://vintagesummerfashion.com, hereinafter referred to as the “online store ”.

III. General provisions

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as "You", the "user") with Vintage Summer EOOD, (203592872, hereinafter referred to as "Vintage Summer", "us" or "we"), on the website, the mobile version or for orders by phone.

By using vintagesummerfashion.com and/or placing an order, you agree to be bound by the terms and conditions set forth herein (the “ Terms ”). Please ensure that you have read and understood the Terms before placing your order.

Orders can only be placed by private individuals who do not conduct business activities, are over 18 years of age, and are not placed under guardianship.

The availability of products or services on vintagesummerfashion.com at a particular time does not mean that these products will be available at all times. We reserve the right to discontinue offering any product on our online store at any time.

We reserve the right to change these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be the one posted on vintagesummerfashion.com at the time you place your order.

 

IV. Ordering/Concluding a Contract

To use the vintagesummerfashion.com e-store and purchase goods, you must enter a name and password of your choice, thus creating your own profile on the platform or go through the procedure via the "Order as a guest" option on the vintagesummerfashion.com website , which is deemed to indicate that you agree and have accepted these general terms and conditions.

By filling in your details and clicking the "Register" buttons, you declare that you are familiar with these general terms and conditions, you agree with their content and you undertake to unconditionally comply with them. If you use the "Order as a guest" procedure, you are not obliged to create an Account in the online store, but you agree to these General Terms and Conditions and to unconditionally comply with them.

When registering or placing an order, you are obligated to provide accurate and up-to-date data. You are also obligated to promptly update the data specified in your registration or order if any changes occur.

After you place your order, you will receive a confirmation email. If for any reason we are unable to fulfill your order, we will notify you as soon as possible. If we have already received payment for such order, we will attempt to refund the relevant amount using the same payment method that was used to make the payment. If for any reason another arrangement is necessary, we will notify you and ask you to contact Customer Service by email. info@vintagesummerfashion.com, where the refund will be arranged.

To purchase a product:
(1) You enter the Products section;
(2) You select one or more of the offered goods and add them to the "Cart" section of the store, and you must also specify the quantity to purchase;
(3) Provide the necessary data for the order - name, phone number;
(4) You provide data for delivery - address, name of Econt office for delivery to Bulgaria;
(5) You choose the method and time for paying for the goods.

(6) Choose a delivery method.
(7) You confirm the order.

 

 

V. Prices and delivery costs

The prices shown on vintagesummerfashion.com include the legally due value added tax, but do not include shipping costs.

Discounts, promotions and gifts are provided by the Supplier to the Consumers in compliance with the requirements of the Consumer Protection Act and in accordance with the terms and conditions announced by the Supplier through the e-shop for the relevant goods.

Shipping costs for each order are fixed:

FREE SHIPPING on orders over 150 BGN.

Delivery price to an Econt office nationwide: 5.50 BGN.

Price for delivery to an address throughout the country: 8.50 BGN.

Each customer fills in their own delivery details in the online store, and if they choose "delivery to an Econt office", they must enter the exact name of the Econt office during the order completion. Delivery to Bulgaria is carried out by Econt Bulgaria OOD. If we cannot deliver your order in one shipment and we have to make more than one delivery, there will be no additional fees for subsequent deliveries.

If a shipment is refused, the customer owes the shipping costs to and from the destination, described below in the Return of Goods section.

VI. Delivery

We strive to ship orders as quickly as possible and in the order in which they were placed. Our goal is to ship your order within 6 to 10 business days of your order confirmation. If delivery may take longer due to unforeseen circumstances, we will contact you by email or phone. If the delivery time exceeds 30 days, you may cancel your order. For orders placed on Fridays after 2 p.m., Saturdays and Sundays, as well as on public holidays, the processing time starts on the first business day.

After you order, you will receive an email confirmation with information about when your order is expected to be delivered.

If your order does not arrive by the scheduled date, please contact Vintage Summer Customer Service at 0887501640 or via email. info@vintagesummerfashion.com.

VII . Order Cancellation

(1) You may cancel or return your order from the date you place your order, up to 14 days after receiving the ordered goods, in unworn, unwashed or undamaged condition. If you have paid for the goods, we will refund the amount, but standard delivery costs will not be refunded, as will the costs of returning the goods to Vintage Summer Ltd., if any. If you decide to keep certain goods and only partially cancel your order, delivery costs will also not be refunded.

If you wish to cancel or return your order, please notify us in writing by sending an email to: info@vintagesummerfashion.com ; by sending back the goods(s) as specified in section 8 (Return of goods) below within the 14 day period. We will refund the funds, using the same payment method used to make the payment, as soon as possible and at the latest 14 days from the date of receipt of the notification of cancellation of the order, only if we have received the goods or proof that they have been sent back.

If the goods you receive are defective, please notify Vintage Summer promptly and return the goods as set out in Section 8 (Return of Goods) below. We will refund the full amount you paid for any products found to be defective. The clauses set out in this document do not limit any applicable statutory rights.

Goods that cannot be returned or exchanged:

–       Goods made to order or according to the individual requirements of the customer; Garments made to a specific length approved by the customer.

 

VIII. Return of goods

You have the right to return your order within 14 days. The return period starts from the day the last item(s) of your order is delivered.

How can I return an item?

If you would like to return something, please use the following steps:

1) Fill out the Return Form and state the reason for returning the item.

2) Place the item you wish to return, including the Return Form, in the package your order arrived in. Please remember that the Return Form must always be included with the item being returned.

3) Send the package back via the courier company Econt Bulgaria. You can do it directly from their office or contact them by phone at 07001 7300 (Price: The cost of a local call or according to your operator's tariff plan) to schedule the return of the goods.

The return is at YOUR expense.

IMPORTANT: In the event of a defective item or a mixed-up shipment, Vintage Summer Ltd. will cover the courier return services described above.

4) For orders placed and paid for by cash on delivery, please register the details of the account to which you would like the amount to be refunded on the form that you return together with the goods.

5) Don't forget to write down your order number, in case of need to contact the "Customer Service" department.

6) The fee for returning goods is 5.50 BGN. If the customer has not paid the return amount, it will be deducted from the refund amount for the order.

7) Once we receive your shipment at our warehouse, we will send you a return notification via email, confirming receipt of the shipment.
If you return any of the ordered items or the entire order, its value will be refunded via the original payment method, minus the return shipping costs if they have not already been paid. The amount for returned goods paid for by bank card will usually be refunded to the card you used for the purchase. For returned goods paid for by cash on delivery, please provide your bank details to which you would like us to refund the amount on the form that comes with the goods.

8) In order for us to refund your amount, please keep the following in mind:

●      The refunded amount is in Bulgarian leva.

●      We refund only to a Bulgarian bank account.

●      The bank account provided must match the name of the person who created the account on vintagesummerfashion.com. 

9) If you have not saved the Return Form, you can print it here or contact Customer Service for assistance by email: info@vintagesummerfashion.com.

10) Vintage Summer guarantees a full refund of the amount paid, as described in section 4 (Order Withdrawal), provided that all goods are returned in the same condition in which they were when you received them. This means that the goods must not have been damaged, soiled, washed, altered or worn (except for being measured) and that all labels or markings must be in place.

IX. Replacement of goods

The consumer has the right to request a replacement for a purchased item within 30 days of receipt, using the return/exchange form, in case the item received does not match the item requested for purchase or has a manufacturing defect.
The consumer returns the purchased goods for exchange no later than 30 days from receipt, and must present a receipt for the purchased goods or a delivery document from Econt.
The supplier has the right to refuse to accept the requested exchange if it finds contamination or damage to the goods, as well as if it has not been returned in its original packaging.
The Supplier replaces the purchased goods with another good of the same type and quality, or in the absence of such - with a good of the customer's choice for the same value. In case the goods were on promotion at a reduced price, the customer has the right to exchange them with another good at the same price that the customer actually paid to the Supplier.

X. Payment methods

Credit card or debit card
You can pay with a valid credit or debit card by entering your payment details at the time of placing the order. The corresponding amount will be withdrawn immediately from your card. The servicing bank of the online store is Unicredit Bulbank, and we reserve the right to check the validity of the credit or debit card, its status in relation to the value of the order and whether the buyer's address details are correct. We may refuse to fulfill orders depending on the results of these checks.

Cash on delivery
You can choose to pay by cash on delivery upon receipt of the goods, without additional fees, by selecting this option when completing your order.

In case the value of the User's order is equal to or exceeds 10,000 BGN, payment is made only by transfer or deposit into the Supplier's payment account.

XI. Colors and sizes

The color you see depends on your computer system and we cannot guarantee that your monitor, phone, tablet or other electronic device will display these colors accurately.

You can see the dimensions of an item in the size chart attached to each product in the store.

You can easily determine which size range would be most suitable for you, as Vintage Summer is not responsible for any incorrect size selection by the user.

Please note that the dimensions themselves are approximate values ​​​​according to world standards, so that you can get an idea of ​​​​the model or cut of a given garment and are not a guarantee of the actual dimensions of the item you will receive, as well as how it would fit you. The dimensions of a given item may vary depending on the manufacturing material of the given garment/item.

The photos of the models are for illustrative purposes only and we cannot guarantee that a given product will fit you in the same way. For your convenience, we have described the dimensions of each model in the "Details" section.

 

XII. Warranty

If you discover any obvious defects related to the material or workmanship of the goods you have received, including damage incurred during transportation, please notify us immediately by email at: office@vintagesummerfashion.com by sending the goods back to us using the pre-printed return form provided, which is part of your shipment. In Section VIII you can see more information on how to return an item to us.

XIII. Liability

The User of the online store www.vintagesummerfashion.com undertakes to indemnify and hold harmless the Provider from legal claims and other claims of third parties (regardless of whether they are justified or not), for all damages and expenses (including attorneys' fees and legal costs) arising from or in connection with (1) failure to fulfill any of the obligations under this contract, (2) violation of copyright, production, broadcasting rights or other rights to intellectual or industrial property, (3) unlawful transfer to other persons of the rights granted to the User, for the term and under the terms of the contract and (4) false declaration of the presence or absence of the status of a consumer within the meaning of the Consumer Protection Act.
Vintage Summer Ltd. is not liable in the event of force majeure, random events, Internet problems, technical or other objective reasons, including orders of the competent state authorities.
The Provider is not liable for damages caused by the User to third parties.
The Supplier is not liable for any material or non-material damages, expressed in lost profits or damages suffered by the User in the process of using or not using the e-shop vintagesummerfashion.com and concluding purchase and sale contracts with the Supplier.
The Provider is not responsible for the time during which the e-store was unavailable due to force majeure.
The Supplier is not liable for any damages resulting from comments, opinions and publications under the products in the online store vintagesummerfashion.com.

The Provider is not liable in the event of overcoming the security measures of the technical equipment and resulting in loss of information, dissemination of information, access to information, restriction of access to information and other similar consequences.
The Provider is not liable in the event of concluding a purchase and sale contract, providing access to information, loss or change of data occurring as a result of false identification of a third party who presents himself as the User, if it can be judged from the circumstances that this person is the User.

XIV. Protection of Personal Data

Vintage Summer Ltd. takes measures to protect the personal data of its users in accordance with the Personal Data Protection Act.
For reasons of security of the Users' personal data, the Provider will send the data only to the e-mail address that was specified by the Users at the time of registration.
The Provider has the right to store data in the User's terminal communication device, unless the latter explicitly expresses his/her disagreement with this.
The User agrees that the Provider has the right to send electronic messages to the User at any time as long as the User is registered in the Provider's e-store.
The User agrees that the Provider has the right to collect, store and process data about the User's behavior when using the e-store.
At any time, the Provider has the right to require the User to identify themselves and to verify the authenticity of each of the circumstances and personal data declared during registration.

"The User agrees that the Provider has the right to send informational and advertising messages to the User (via short telephone message) as long as the User is registered in the Provider's e-store."

XV. Other conditions

Intellectual Property and Company Image Protection

Vintage Summer wants to provide the best online experience possible, that is why you understand and agree not to abuse the intellectual property rights and the legitimate and proper use of the online store vintagesummerfashion.com. You agree not to (1) send, transmit, redistribute, upload or advertise any messages or content that may harm or negatively affect our business, products or services; (2) act in a manner or use any device that restricts, disrupts, interferes with or slows down the use of vintagesummerfashion.com.com by any other user or that affects the security of the site or (3) attempt to use any facility, software, tool, means, script or other device or mechanism (including without limitation spiders, bots, robots, avatars or intelligence means) to search or navigate the site, or to copy content from the site. The site is owned by Vintage Summer EOOD and is subject to copyright. All photos, texts and content are copyrighted and may not be shared or copied without permission. We reserve the right to immediately prohibit access to the site and close the account of any user who violates this provision or any other provision related to the Terms and Conditions.

Legal parameters

The User and the Supplier in the online store vintagesummerfashion.com undertake to mutually protect their rights and legitimate interests, as well as to protect their trade secrets that have become their property in the process of fulfilling the contract and these general terms and conditions.
The User and the Provider undertake, during and after the expiration of the contract period, not to make public any written or oral correspondence conducted between them. Public domain may include the publication of correspondence in printed and electronic media, Internet forums, personal or public websites, etc.
For issues not settled in this contract, related to the implementation and interpretation of this contract, the laws of the Republic of Bulgaria shall apply.
The User has the right to refer all disputes with the Provider regarding the performance of this contract to the out-of-court alternative dispute resolution (ADR) platform, available at https://webgate.ec.europa.eu/odr/main/?event=main.home.show. In the event of failure to reach an agreement to resolve the dispute out-of-court, the parties may refer the dispute for resolution by the competent Bulgarian courts and the Consumer Protection Commission.
